US Supreme Court Reviews Trump’s Push to End Birthright Citizenship
On January 20, 2025, President Donald Trump issued a landmark executive order aiming to revoke automatic US citizenship for children born on American soil to parents who are neither citizens nor lawful permanent residents.
This challenge directly confronts the 14th Amendment’s Citizenship Clause, ratified in 1868, which grants citizenship to anyone born within US borders.
Lower courts blocked the order nationwide for violating constitutional protections enjoyed by an estimated 13 million undocumented immigrants’ US-born children.
Now, the Supreme Court must determine if only a rigorous constitutional amendment process can alter this century-and-a-half-old principle.
