Inside the 25th Amendment Push Against Trump
The 25th Amendment has resurfaced as a primary topic of debate in Washington, specifically focusing on Section 4, which outlines the process for removing a president deemed “unable to discharge the powers and duties of his office.” For this to occur, Vice President JD Vance and a majority of the Cabinet would need to submit a written declaration to Congress.
Once invoked, the Vice President immediately assumes the role of Acting President. However, President Trump can reclaim power by declaring no disability exists, at which point the Vice President and Cabinet have four days to challenge that claim.
Ultimately, if a dispute arises, it falls to Congress, where a two-thirds majority in both the House and Senate is required to keep the President from resuming his duties.
While dozens of lawmakers are currently calling for this action due to fears over recent escalations in the Iran conflict, the high legal threshold and the requirement of Vice Presidential support make it one of the most difficult constitutional maneuvers to execute.
